Artificial Intelligence Supplementary Terms

These Artificial Intelligence Supplementary Terms ("AI Terms") supplement the BrandFlow Terms of Service and govern your use of AI-powered generation features within the Service, including text (copy, captions, email, ad copy), image, video, and audio generation. Capitalized terms not defined here have the meaning given in the Terms of Service. In the event of any conflict between these AI Terms and the Terms of Service, these AI Terms control with respect to the AI features described herein.
1. AI Providers
BrandFlow's AI generation features are powered by the following third-party providers:
- Anthropic — primary large language model (LLM) provider, used for campaign planning, copy generation, brand voice analysis, and strategic content
- Runware — image generation (primary)
- Higgsfield — video generation and cinematics
- Replicate — image and video generation (fallback)
Your use of AI generation features is also subject to the acceptable use policies of each applicable provider, including Anthropic's Usage Policy. BrandFlow selects and may change AI providers at its discretion to improve service quality, cost, or reliability. Material changes to AI provider arrangements that affect your outputs will be disclosed via the Service changelog or email.
2. No Training on Your Data
BrandFlow does not use your User Content — including brand assets, uploaded media, prompts, or AI-generated outputs — to train, fine-tune, or improve any AI model, whether operated by BrandFlow or by any of our AI provider partners. Your content is used exclusively for the purpose of generating outputs requested by you within the Service.
Where our AI providers process your prompts and content as part of inference, they do so subject to their own data handling agreements and commitments. We select providers whose terms do not permit training on API customer data.
3. Ownership of AI-Generated Outputs
Subject to your compliance with these AI Terms and the Terms of Service, and to the extent permitted by applicable law, BrandFlow assigns to you all right, title, and interest (including any copyright) in AI-generated text, images, video, and audio produced through the Service at your direction.
You acknowledge that: (a) AI-generated outputs are produced algorithmically and may resemble content generated for other users; (b) BrandFlow does not guarantee that AI-generated outputs are unique, protectable by copyright in all jurisdictions, or free from third-party intellectual property claims; and (c) you are solely responsible for reviewing outputs and obtaining any licenses or clearances required before commercial use or publication.
4. Prohibited Uses of AI Features
You may not use BrandFlow's AI generation features to:
- Generate content that impersonates real individuals without their consent, including synthetic voice or video of real persons
- Produce non-consensual intimate imagery or sexually explicit content involving real or realistic-looking individuals
- Create or distribute disinformation, deepfakes intended to deceive, or content designed to manipulate elections or public discourse
- Generate content that violates any applicable law or regulation, including laws governing advertising, consumer protection, financial advice, or medical claims
- Publish AI-generated content while falsely representing it as human-authored in any context where such disclosure is legally required (e.g., political advertising in certain jurisdictions)
- Use outputs to train, fine-tune, or benchmark any machine learning model without BrandFlow's written consent
- Generate spam, phishing content, or automated communications designed to deceive recipients
- Attempt to extract, replicate, or reverse-engineer the underlying AI models used by BrandFlow or its providers
5. Your Responsibility for Outputs
You are solely responsible for reviewing all AI-generated content before publishing or otherwise using it. BrandFlow provides Brand Guard and other review tools to assist you, but these tools do not constitute legal, compliance, or professional advice and are not a substitute for your own judgment. You should ensure that all published content complies with applicable law, platform terms, and industry standards, including advertising disclosure requirements and any applicable truth-in-advertising rules.
AI outputs may occasionally contain inaccurate, outdated, or biased information. BrandFlow is not liable for any damages arising from your reliance on or use of AI-generated content.
6. No Warranty on AI Outputs
AI-GENERATED OUTPUTS ARE PROVIDED "AS IS." BRANDFLOW MAKES NO WARRANTY, EXPRESS OR IMPLIED, THAT AI-GENERATED TEXT, IMAGES, VIDEO, OR AUDIO WILL BE ACCURATE, COMPLETE, ORIGINAL, NON-INFRINGING, SUITABLE FOR ANY PARTICULAR PURPOSE, OR FREE FROM ERRORS OR OFFENSIVE CONTENT. THE DISCLAIMERS AND LIMITATIONS OF LIABILITY IN THE TERMS OF SERVICE APPLY IN FULL TO ALL AI FEATURES AND OUTPUTS.
7. Updates to These AI Terms
BrandFlow may update these AI Terms as our AI capabilities, provider relationships, or applicable law evolve. We will notify you of material changes via email or a notice in the Service. Continued use of AI features after the effective date of any update constitutes your acceptance of the revised AI Terms.
